Judge Revives Lawsuit Over Hebrew National Hot Dogs
A federal appeals court judge revived a lawsuit against ConAgra Foods Inc. today, over one year after a trial judge dismissed the case which involved allegations that ConAgra’s Hebrew National hot dogs are not kosher.
The judge ruled that the trial court erred in dismissing the lawsuit, which was filed by 11 consumers who claim they were misled into paying a premium price for Hebrew National hot dogs that were not subject to the religious procedure necessary to make them kosher.
The trial judge dismissed the lawsuit in its entirety, stating that the First Amendment prevented him from addressing the religious questions involved in the case.
Today, the 8th U.S. Circuit Court of Appeals reinstated the case, removing it from federal court and returning it to the Minnesota state court where it was first filed.
