Court Revives Lawsuit Against VA over Marine’s Suicide

A federal court has reinstated a lawsuit against the federal government by the family of a Marine who committed suicide after being denied treatment at two Veterans Affairs clinics in Lexington, Kentucky.

On Friday, the U.S. 6th Circuit Court of Appeals revived the lawsuit, which was filed by the family of 21-year-old Cameron Anestis against the federal government in 2011. The suit, which sought $22.5 million in damages, had been dismissed by a lower court on the grounds that the federal courts lacked jurisdiction.

According to court documents, Anestis was turned away by two VA hospitals when he sought treatment for severe mental and emotional problems he experienced after returning from a tour of duty in Iraq.

The family alleges that the VA acted negligently when it refused to treat the Marine.
